Reporting to the Territorial Director, Healthy Workplace the incumbent serves TSA Mission by supporting the Territory with accountability for workplace investigative services. The incumbent is focused on high quality HR service delivery, partnerships and innovation, aimed at building a healthy workplace in service of our mission.
The Territorial Workplace Resolution Facilitator and Senior Analyst will assume full responsibility on behalf of The Salvation Army Canada & Bermuda for carrying out complex human relations investigations, including but not limited to workplace complaints, harassment, discrimination, violence, human rights complaints, professional misconduct, theft, breach of organizational policies, and performance management issues.
In accordance with established investigative practice, the objective of the Investigator is to investigate complex human relations issues thoroughly and expeditiously in a fair, unbiased and consistent manner. The Territorial Workplace Resolution Facilitator & Senior Analyst works closely with managers, directors, supervisors, Officers as well as other HR staff at the Regional and Ministry Unit level. The Territorial Workplace Resolution Facilitator & Senior Analyst promotes and fosters a consultative and problem-solving employee relations approach according to the Workplace Relations principles that contributes to the achievement of the goals and objectives for developing a healthy workplace and of TSA.
The Territorial Workplace Resolution Facilitator and Senior Analyst will retain metrics and analyze the current environment and trends. Liaison with EFAP provider to make expert resources available for staff and ensure that divisional HR is aware. Advise workers of healthy workplace and mental health resources and facilitate and administer appropriately.
KEY RESPONSIBILITIES:
Accountabilities:
Workplace Relations Investigations:
- Investigates complex and sensitive internal disputes, including but not limited to complaints of discrimination and harassment, violence, abuse, professional misconduct, breach of organizational policies and performance management issues using best practice investigatory procedures.
- Maintains thorough records of investigations.
- conducts intake interviews.
- prepares comprehensive investigation reports.
- conducts fact-finding tasks, including interviewing and collecting documentary evidence.
- manages complaint investigation case files, in both hard copy and electronic formats.
- maintains confidential and up-to-date case files
- recommends alternative dispute resolution options, including formal mediation; and drafts investigative reports and complaint resolution documents for review by the Territorial Director, Healthy Workplace.
Investigation Analysis:
- Collects and analyzes witness statements and documentary evidence and makes credibility determinations
- Prepares thoughtful and thorough investigative reports and recommendations for corrective action
- Prepares a detailed analysis of each allegation and the related evidence, both pro and con, the application of related policies and procedures, guidelines, principles
- Participates in review of the investigation and amalgamation of substantive programmatic input from Territorial, Divisional and Ministry Unit Human Relations, Divisional Commander, Territorial Abuse Advisor, Legal and/or the Personnel Secretary where applicable.
- Serves as a participant in drafting the final recommendations for resolve of the matter being investigated.
Maintains Data and Metrics Regarding the Current Environment:
- Retains all investigation data and exit interview information.
- Identifies where systemic workplace problems exist as a result of analysis of investigative statistics
- Responsible for identifying and analyzing trends in complaints to identify possible systemic issues, gaps in service levels or methods to improve internal processes that impact operations.
Employee Assistance Program/Mental Health Resources:
- Liaison with EFAP provider to understand resources available, obtain relevant resources for staff and ensure that divisional HR is aware of availability.
- Advise workers of mental health resources and administer appropriately.
Collaboration, Communication and Education:
- Educates managers and employees, through one-on-one interactions and formal trainings, on the investigation process.
- Prepares for and participates in meetings, hearings or grievances related to results of investigations.
- Stays abreast of regulations and statutes relating to and not limited to discrimination, retaliation, harassment, abuse, sexual misconduct and violence.
- Provides input to proposed recommending action items based on knowledge of problem areas that have emerged during investigation processing.
- Understanding and knowledge of Early Resolution / Informal Resolution practices.
- Builds internal professional relationships to effectuate HR Compliance initiatives and policies.
Perform other position related duties as required.
QUALIFICATIONS AND EDUCATION REQUIREMENTS:
Education, Qualifications and Certifications:
- Completion of a university degree in social sciences, human resources, or related field.
- Certified Workplace Investigator training and certification in conflict resolution and/or alternative dispute resolution
- An equivalent combination of education, training and experience may be considered.
- Valid Ontario Class “G” Driver’s License, own vehicle and insurance and a current copy of driver’s abstract that is satisfactory to The Salvation Army, in its sole discretion, is required.
Experience and Skilled Knowledge Requirements
- Minimum of 5-7 years progressively responsible experience in the human resource field, conducting neutral and thorough investigations with emphasis on the labour relations function including three years’ experience; in conflict resolution and/or alternative dispute resolution
- Strong HR generalist experience with a history of building strong client relationships and serving multiple facilities with a preference for social enterprise/not for profit/faith based experience.
- Prior experience or good working understanding of union and non-union environments.
- Ability to apply objective investigative procedures, including interviewing, report writing, and the ability to use sound judgment in combination with policy and legislation to make comprehensive decisions.
- Ability to apply various conflict resolution methods (e.g., mediation, negotiation, restorative practices) and the ability to identify and implement strategies for successful outcomes.
- Excellent judgement skills including the ability to consider human and organizational costs associated with conflict in the workplace.
- Knowledge of appropriate legislation (Canadian Employment Legislation, Human Rights Code and Privacy Legislation), collective agreements including grievance processes, legal precedents, and policies regarding harassment, dispute resolution and employment.
- Ability to apply knowledge of human behaviour and performance; individual differences in ability, personality, and interests; societal trends and influences.
- Ability to maintain, in strictest confidence, information received concerning confidential matters such as harassment complaints, grievances, labour relations, staffing and recruiting performance management and any other information deemed to be of a confidential nature.
- Develop an understanding and support for the mission and purpose of The Salvation Army in Canada and its implications as related to position responsibilities.
